CONCERNING
EXPLOSIVE MATERIALS

PRESIDENTIAL DECREE ON EXPLOSIVE MATERIALS.

Article 1

(1) Meant in this Presidential Decree as explosive material shall be a substance or agent in solid, liquid, gas form or its combination, that if exposed with an action in the form of heat, impact or friction will change chemically into other agents that mostly or all are in the form of gas, and such a change occurs within a very short period, accompanied with effect and very high pressure.

(2) Explosive as contemplated in paragraph (1) consists of explosive for military purpose and explosive for industrial (commercial) purpose.

(3) Further detail on the explosive for military purpose and for industrial (commercial) purpose as contemplated in paragraph (2), shall be stipulated by the Minister of Security Defence in viewing of consideration of ministers in charge of industry, trade, and health.

Article 2

(1) Production, procurement, storage, and distribution of explosive is conducted by business entity after obtaining license from the Minister of Security Defence.

(2) In case the business entity as contemplated in paragraph (1) conduct export and import of explosives and their components, then the licence is given by the minister in charge of trade sector after obtaining recommendation from the Minister of Security Defence.

(3) Arrangement, fostering and development of explosive industry is conducted by the Minister of Security Defence.

Article 3

The Minister of Security Defence stipulates requirements of business entity as contemplated in Article 2 after obtaining consideration from the minister in charge of finance, industry, trade and health sector and the Chief Police of the Republic of Indonesia.

Article 4

(1) Business entity that has obtained licence as contemplated in Article 2 shall make annual work program for each activity of production, procurement, storage, and distribution of explosive.

(2) Implementation of the annual work program as contemplated in paragraph (1) must obtain a prior legalization from the Minister of Security Defence or his/her assignee.

Article 5

(1) In order to guarantee compliance of provisions in this Presidential Decree, the Minister of Security Defence conduct supervision on the production, procurement, storage, and distribution of explosive, in coordination with:

(2) The Minister of Security Defence may revoke the license as contemplated in Article 2, if based on supervision the business entity fails to meet provisions as contemplated in Articles 2, 3 and 4 hereof.

Article 6

Further provisions that are required for implementation of this Presidential Decree, shall be regulated by the Minister of Security Defence.

Article 7

(1) Upon coming into force of this Presidential Decree, then Presidential Decree Number 5 of 1988 on Procurement of Explosives as several times amended, most recently by the Presidential Decree Number 14 of 1997 is declared null and void.

(2) All implementing provisions of Presidential Decree Number 5 of 1988 as several times amended, most recently by the Presidential Decree Number 14 of 1997 shall remain be effective as long as not contradict to and until issuance of new provision based on this Presidential Decree.

Article 8

Upon coming into force of this Presidential Decree, then all business entities that have been appointed in the Presidential Decree Number 5 of 1988 as several times amended, most recently by the Presidential Decree Number 14 of 1997 to conduct production, procurement, storage, and distribution of explosives are deemed have obtained permit from the Minister of Security Defence based on this Presidential Decree.

Article 9

Presidential Decree comes into force as of the date of stipulation.
